Law firm files suit against Gila Medical Center over alleged unsolicited faxes

MIAMI – A Miami law firm has filed a class-action suit against a Miami medical center and doctor over allegations they sent unsolicited faxes.

Law Offices of Timothy Carl Blake PA filed a complaint on behalf of all others similarly situated on July 25 in the U.S. District Court for the Southern District of Florida, Miami Division against Gila Medical Center Inc. and Dr. Lilia Rodriguez Ables alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that on June 28, it received an unsolicited advertisement through its telephone facsimile machine from the defendants. The plaintiff holds Gila Medical Center Inc. and Rodriguez Ables responsible because the defendants allegedly sent plaintiff a facsimile advertisement without providing any opt-out notices as required by law to promote their medical services.

The plaintiff requests a trial by jury and seeks statutory damages, interest, all legal fees and any other relief as the court deems just. It is represented by Shawn A. Heller and Joshua A.
