MIAMI – A Palm Beach County business is facing a suit from a former human resources employee over allegations that she was not paid overtime compensation.
Linh Morrison filed a complaint on July 25 in the U.S. District Court for the Southern District of Florida against Top Cut Lawn Services Inc. and Stephen H. Miller alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between March 2015 and June, she worked for more than 40 hours without being paid any overtime premiums on all hours she worked in excess of 40. The plaintiff holds Top Cut Lawn Services Inc. and Miller responsible because the defendants allegedly failed to pay plaintiff any overtime wages at a rate of time-and-one-half.
The plaintiff requests a trial by jury and seeks award overtime compensation, liquidated damages, all legal fees and interest and any other relief as the court deems just. She is represented by Arthur Schofield of Arthur T. Schofield PA in West Palm Beach.
