Wells Fargo alleged to have repeatedly called woman despite requests to stop

FORT MYERS – A Lehigh Acres woman has filed suit against a financial institution alleging it repeatedly called her using an autodialer.

Hilary Powell filed a complaint on July 18 in the U.S. District Court for the Middle District of Florida, Fort Myers against Wells Fargo Bank NA alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that in February, the defendant repeatedly contacted her regarding an alleged debt and to offer its services to refinance, modify, short sale or foreclosure the debt. The plaintiff claims she asked the defendant to stop calling her. The plaintiff holds Wells Fargo Bank NA responsible because the defendant allegedly used an automatic dialing system in contacting plaintiff.

The plaintiff requests a trial by jury and seeks statutory damages, punitive damages, actual damages, all legal fees and interest, and any other relief as the court deems just. She is represented by Shaughn C. Hill of Morgan & Morgan Tampa PA in Tampa.
