ORLANDO – An Osceola County man who was employed as a delivery driver alleges he was misclassified as an independent contractor and not paid overtime wages. He has filed a class-action suit.
Obed Vazquez filed a complaint on behalf of all others similarly situated on July 21 in the U.S. District Court for the Middle District of Florida Orlando Division against Joseph Cory Holdings LLC alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between November 2014 and October 2015, he worked for more than 40 hours per week without being paid any overtime premium. The plaintiff holds Joseph Cory Holdings LLC responsible because the defendant allegedly failed to pay overtime wages at a rate of time-and-one-half to plaintiff.
The plaintiff requests a trial by jury and seeks damages of $5,000, unpaid back wages, all legal fees and any other relief as the court deems just. He is represented by Luis A. Cabassa of Wenzel Fenton Cabassa PA in Tampa.
