MIAMI – A German artist alleges a Miami business has copied his works of film icons for resale.
Michael Moebius filed a complaint on July 18 in the U.S. District Court for the Southern District of Florida, Miami Division against Kfir Moyal, Kfir Moyal Art Gallery Inc., Carza Art LLC and John and Jane Does 1 through 10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that he suffered damages as the result of his works of Marilyn Monroe Bubble Gum and Audry Hepburn Bubble Gum being copied and displayed without his authority by the defendants. The plaintiff holds Kfir Moyal, Kfir Moyal Art Gallery Inc., Carza Art LLC and John and Jane Does 1 through 10 responsible because the defendants allegedly copied, reproduced and offered for sale the infringing works of plaintiff's.
The plaintiff requests a trial by jury and seeks to enjoin the defendant; award compensatory damages, gains, and profits derived from the infringing acts; punitive damages; interest, order the defendants to destroy all infringing works; and any other relief as the court deems just. He is represented by Joel S. Magolnick and Veronica M. Rabinowitz of Marko & Magolnick PA in Miami.
