FORT LAUDERDALE – A restaurant employee has filed suit alleging he regularly worked more than 40 hours per workweek and was not paid appropriately.
Gustavo Gabriel filed a complaint on behalf of all other employees of defendants similarly situated on July 12 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Cafe Del Mar of Fort Lauderdale Inc. and Leone Padula alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between May 2013 to the present date, he worked for more than 40 hours per workweek without being paid the legal minimum wage as well as any overtime wages. The plaintiff holds Cafe Del Mar of Fort Lauderdale Inc. and Padula responsible because the defendants allegedly failed to pay any overtime compensation to plaintiff for all hours worked in excess of 40 hours per week.
The plaintiff requests a trial by jury and seeks to permanently enjoin the defendant, award plaintiff all owed compensation, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by Santiago J. Padilla of Fowler Rodriguez LLP in Coral Gables.
