Deutsche Bank National Trust Co. alleged to charge different interest rate on mortgage

MIAMI – A bank is accused of using false, deceptive or misleading representations in the connection with a mortgage interest rate.

Ghislaine Bernard filed a complaint on July 14 in the U.S. District Court for the Southern District of Florida against Deutsche Bank National Trust Co. alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in September 2014, a final judgment was entered in a foreclosure action that stated the interest rate would be set at the rate of 4.75 percent per year. The suit states the plaintiff filed for bankruptcy in March. The plaintiff holds Deutsche Bank National Trust Co. responsible because the defendant allegedly attempted to charge a rate higher than 4.75 percent.

The plaintiff requests a trial by jury and seeks actual damages, statutory damages, all legal fees and any other relief as this court deems just. He is represented by Seth Wieder of Loan Lawyers LLC in Fort Lauderdale.
