Suit filed against Baycare Home Care over calls to woman

TAMPA – A Hillsborough County woman has filed suit against a Largo business alleging it called her more than 200 times to solicit medical supplies.

Michelle Miller filed a complaint on July 11 in the Tampa Division of the Middle District of Florid against Baycare Home Care Inc. alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that between August 2013 and this year, she was contacted on her mobile phone several times by the defendant using an automatic dialing system. The plaintiff holds Baycare Home Care Inc. responsible because the defendant allegedly called plaintiff on her cellular telephone to solicit its products to her despite her requests for it to stop calling her.

The plaintiff requests a trial by jury and seeks statutory damages, punitive damages, actual damages, interest, all legal fees and any other relief as the court deems just. She is represented by Frank H. Kerney III of Morgan & Morgan, Tampa, PA in Tampa.
