Cruise passenger alleges knee injuries after fall on ship

Cruise 02

MIAMI – A traveler on the Carnival Victory alleges she fractured her kneecap after a fall on the ship.

Doris Sarmiento filed a complaint on July 7 in the U.S. District Court for the Southern District of Florida, Miami Division against Carnival Corp., doing business as Carnival Cruise Line, alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 2, 2015, she sustained physical injuries when she slipped and fell on water. The suit states she injured a ligament, fractured her left patella and other injuries. The plaintiff holds Carnival Corp. responsible because the defendant allegedly allowed the floor of its deck to remain wet and failed to provide adequate warning to its passengers regarding the condition of the floor.

The plaintiff seeks damages, medical expenses, all legal fees, interest, all other damages and any other relief as the court deems just. She is represented by John H. Hickey of Hickey Law Firm PA in Miami.
