U Gas alleged to have not paid former employee overtime wages

MIAMI – A cashier alleges a Dade County business did not pay her properly for all hours worked.

Fermin Benavides Blandon filed a complaint on behalf of all others similarly situated on July 7 in the U.S. District Court for the Southern District of Florida against JJ 27 Avenue Station Inc., doing business as U Gas, and Dayana Medina alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Nov. 14, 2014, and July 4, she worked between 40 to 60 hours per week without being paid any overtime wages by the defendants. The plaintiff holds JJ 27 Avenue Station Inc., doing business as U Gas, and Dayana Medina responsible because the defendants allegedly failed and refused to pay plaintiff any overtime compensation of a rate of time-and-one-half for all hours worked in excess of 40 per week.

The plaintiff requests a trial by jury and seeks double damages, all overtime wages still owing, interest, all legal fees and any other relief as the court deems just. She is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
