FORT LAUDERDALE – A Miami-Dade County photographer alleges his photo was used without his permission by two Broward County residents.
Felix Mizioznikov filed a complaint on July 7 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Benisa Forte, Briano Forte and Ronald Roth alleging copyright infringement.
According to the complaint, the plaintiff alleges that he photographed Briano Forte in 2010 and gave the defendants a limited license to use the photos to promote his modeling career. The plaintiff holds Benisa Forte, Briano Forte and Ronald Roth responsible because the defendants allegedly copied and distributed plaintiff's work without his consent, which is in violation of the limited license he granted them.
The plaintiff requests a trial by jury and seeks to enjoin the defendant, actual damages and any profits derived from infringing plaintiff's work, and any other relief as the court deems just.
