MIAMI – A passenger alleges she fell on a wet floor on a cruise ship and the injuries resulted in a total hip replacement.
Eloisa Baptista Mendoza filed a complaint on July 5 in the U.S. District Court for the Southern District of Florida Miami Division against Royal Caribbean Cruises LTD, doing business as Royal Caribbean International, alleging negligence.
According to the complaint, the plaintiff alleges that in Dec. 7, 2015, she sustained physical injuries when she slipped and fell on the wet floor of one of the restaurants aboard the Independence of the Seas cruise ship. The suit states she sustained a fracture that required a total hip replacement and a laceration on her hand.
The plaintiff holds Royal Caribbean Cruises LTD responsible because the defendant allegedly failed to keep the floor of its vessel dry or provide adequate warning to passengers about the condition of the floor.
The plaintiff requests a trial by jury and seeks all damages, medical expenses, all legal fees, interest, and any other relief as the court deems just. She is represented by Brett E. von Borke and Seth Miles of Buckner + Miles in Miami.
