MIAMI – A former cook for a Miami-Dade County restaurant alleges he worked an estimated 15 hours of overtime per week but was not paid accordingly.
Louis Louicaine filed a complaint on July 6 in the U.S. District Court for the Southern District of Florida, Miami Division against Buena Vista Bistro LLC and Claude Postel alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between 2007 and May 2016, he worked for more than 40 hours a week without being paid any overtime wages. The plaintiff holds Buena Vista Bistro LLC and Postel responsible because the defendants allegedly failed to pay overtime wages at a rate of one-and-one-half to plaintiff for all hours worked in excess of 40 per week.
The plaintiff requests a trial by jury and seeks payment of all overtime wages at the legal rate, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by Robert W. Brock II of Law Office of Lowell J. Kuvin in Miami.
