Man alleges Advenir Real Estate Management avoided paying overtime wages

MIAMI – A maintenance worker alleges his employer modified his time records to avoid paying him overtime.

Jose Avello filed a complaint on June 27 in the U.S. District Court for the Southern District of Florida, Miami Division against Advenir Real Estate Management LLC alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours for the defendant but was not paid any overtime wages. The plaintiff holds Advenir Real Estate Management LLC responsible because the defendant allegedly failed to pay any overtime compensation at a rate of time-and-one-half to plaintiff for all his hours worked in excess of 40 per week and modified his time card to show he worked less than 40 hours.

The plaintiff requests a trial by jury and seeks overtime compensation, liquidated damages equal to the unpaid overtime wages, interest, all legal fees and any other relief as the court deems just. He is represented by Richard Celler of Richard Celler Legal PA in Davie.
