MIAMI – A home health aide has filed suit against her Miami-Dade County employer alleging that she was not properly paid for all hours worked.
Maria T. Serrato Azaath filed a complaint on July 1 in the U.S. District Court for the Southern District of Florida against Moral Home Services Inc., doing business as Assisting Hands Home Care, and Armando Morales Rose alleging violation of the Fair Labor Standards Act, breach of contract and unjust enrichment.
According to the complaint, the plaintiff alleges that she worked for more than 40 hours per workweek for the defendants but was not paid any overtime wages from February 2014 to the present. The plaintiff holds Moral Home Services Inc. and Armando Morales Rose responsible because the defendants allegedly failed to pay any overtime compensation of time-and-one-half to plaintiff for all her hours worked in excess of 40 hours and instructed her not to record all of the hours she worked.
The plaintiff requests a trial by jury and seeks all damages, interest, all legal fees and any other relief as the court deems just. She is represented by Brian H. Pollock of Fairlaw Firm in Miami.
