Woman alleges disability benefits were wrongfully terminated

WEST PALM BEACH – A Palm Beach woman alleges that her insurance company wrongfully terminated her from receiving disability benefits because it claims she is no longer disabled.

Jill Goermar filed a complaint on June 29 in the U.S. District Court for the Southern District of Florida, West Palm Beach Division against Life Insurance Co. of North America citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she was disabled under the terms of the plan and was initially approved for disability benefits in February 2013, but was suddenly terminated by the defendant on July 24, 2013. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly terminated plaintiff's long-term disability benefits based on its claim that she is no longer disabled.

The plaintiff seeks payment of disability benefits, disgorgement, interest, all legal fees and any other relief as the court deems just. She is represented by Maggie Smith and Alicia Paulino-Grisham of DI Law Group in Hollywood.
