Delivery driver alleges he was not properly paid for all hours worked

MIAMI – A delivery driver alleges his former Broward County employee did not pay him the overtime rate for hours worked in excess of 40 per week.

Ismael Venegas filed a complaint on behalf of all others similarly situated on June 30 in the U.S. District Court for the Southern District of Florida against Acri Design & Trade Corp. and Gustavo Torres citing violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Oct. 26, 2013 and June 28, he worked for an average of 65 hours per workweek but was not paid any overtime wages by the defendants. The plaintiff holds Acri Design & Trade, Corp., and Gustavo Torres responsible because the defendants allegedly failed to pay any overtime compensation to plaintiff for all his hours worked in excess of 40 hours per workweek.

The plaintiff requests a trial by jury and seeks double damages, interest, all legal fees and any other relief as the court deems just. He is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
