Former Gourmet Table employees seek allegedly unpaid wages

MIAMI – Two former servers for a Coral Gables restaurant allege they were not properly paid during their employment there.

Henry Garcia and Frank Darias filed a complaint on June 21 in the U.S. District Court for the Southern District of Florida, Miami Division against HLMV Imports LLC, doing business as Gourmet Table, and Leonor Landa De Pocaterra alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that between August 2014 and September 2015, they worked for more than 40 hours in a given workweek but were not paid any overtime or proper minimum wages. The plaintiffs hold HLMV Imports LLC and Leonor Landa De Pocaterra responsible because the defendants allegedly failed to pay plaintiffs any overtime compensation for all hours worked in excess of 40, failed to pay minimum wages, and allegedly forced plaintiffs to share tips to management in violation of the FLSA.

The plaintiffs request a trial by jury and seek judgment against the defendants, unpaid pages, to enjoin the defendant from further FLSA violations, all legal fees and any other relief as the court deems just. They are represented by Robert W. Brock II of Law Office of Lowell J. Kuvin in Miami.
