MIAMI – A server has filed a lawsuit against a department store alleging she was not paid a minimum wage.
Elisa Rubini filed a complaint on behalf of others similarly situated individuals on June 20 in the U.S. District Court for the Southern District of Florida, Miami Division against Bloomingdale's Inc. alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that she worked for 30 to 42 hours per week without being paid all of her minimum or overtime wages. The plaintiff holds Bloomingdale's Inc. responsible because the defendant allegedly failed to pay plaintiff any overtime wages and minimum wages at the required legal rate.
The plaintiff requests a trial by jury and seeks all unpaid wages, liquidated damages, all legal fees and any other relief as the court deems just. She is represented by R. Martin Saenz of Saenz & Anderson PLLC in Aventura.
