Former employee alleges wholesale bakery did not pay overtime wages

MIAMI – A man employed as an assistant baker has filed a class-action suit against his former employers over allegations he and other class members were not paid overtime wages.

Martin Huarte filed a complaint on behalf of others similarly situated individuals on June 20 in the U.S. District Court for the Southern District of Florida, Miami Division against Patagon Distribution Inc., Vini Plus Inc., JL Investment Group LLC, Jejema LLC, Ayna LLC, Carniceria Argentina LA Estancia Inc., Patagonia Sunset Corp., Patagonia Nahuen Holdings LLC, Lam Distribution LLC, Patagonia Fund Corp., Asaada Corp and Andres H. Amorosi and Maria I. Amorosi alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Jan. 1, 2014, and Dec. 19, 2015, he worked for more than 40 hours for the defendants but was not paid any overtime wages. The plaintiff holds the defendants responsible because they allegedly failed to pay overtime compensation at a rate of one-and-one-half to plaintiff for all hours worked in excess of 40 hours per workweek.

The plaintiff requests a trial by jury and seeks actual damages, unpaid wages, unpaid overtime wages, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by Martin Saenz and Ed Rosenberg of Saenz & Anderson PLLC in Aventura.
