FORT LAUDERDALE – A Miami-Dade County man has filed a class-action lawsuit against a Broward County employer alleging he wasn't properly paid for all hours worked.
Jose Luis Cardentey filed a complaint on behalf of all other similarly situated individuals on June 20 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Arnet Pharmaceutical Corp. alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he worked for more than 40 hours per workweek but was not paid any overtime wages. The suit states he was employed by the defendant from Feb. 9, 2015, to Aug. 13, 2015. The plaintiff holds Arnet Pharmaceutical Corp. responsible because the defendant allegedly worked an average of 46 hours per week without being paid an overtime rate of time-and-one-half per hour.
The plaintiff requests a trial by jury and seeks actual damages, double damages or liquidated damages, all legal fees and any other relief as the court deems just. He is represented by Martin Saenz and Ed Rosenberg of Saenz & Anderson PLLC in Aventura.
