Online sellers accused of selling counterfeit Abercrombie products

MIAMI – A New Albany, Ohio company alleges several online sellers are offering counterfeit versions of its products.

Abercrombie & Fitch Trading Co. filed a complaint on June 22 in the U.S. District Court for the Southern District of Florida against abercrombieandfitch-coupons.com, aberclothes.us, abercrombi.fr, et al. and Does 1-10 alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges it suffered damages to its business as a result of counterfeit copies of its products being sold by the defendants. The plaintiff holds abercrombieandfitch-coupons.com, aberclothes.us, abercrombi.fr, et al. and Does 1-10 responsible because the defendants allegedly manufactured and distributed counterfeit goods using the internet and sold confusingly similar imitations of plaintiff's products also bearing its trademark.

The plaintiff seeks preliminary and permanent injunction against the defendants, order of cancellation of all domain names used by the defendants, award plaintiff all profits and damages resulting from the defendants' unlawful act, statutory damages in the amount of $2 million for each counterfeit trademark used and sold, all profits and damages, statutory damages in the amount of $100,000 per cybersquatted domain name used, interest, all legal fees and any other relief as the court deems just. It is represented by Stephen M. Gaffigan, Virgilio Gigante, and T. Raquel Rodriguez-Albizu of Stephen M. Gaffigan PA in Fort Lauderdale.
