JACKSONVILLE – A consumer alleges that a debt collector attempted to collect a debt that had already been paid.
John Kanode filed a complaint on May 31 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against NCC Business Services Inc. alleging violation of the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.
According to the complaint, the plaintiff alleges that in March, he was notified by mail by the defendant that he needed to settle his outstanding debt of $636.64, which he paid in full in 2014. The plaintiff holds NCC Business Services Inc. responsible because the defendant allegedly falsely represented the character, amount or legal status of the plaintiff's debt.
The plaintiff requests a trial by jury and seeks statutory damages of $1,000, actual damages, punitive damages, equitable relief, interest, all legal fees and any other relief as the court deems just. He is represented by Alex D. Weisberg of Weisberg Consumer Law Group PA in Cooper City.
