Former Mutual of Omaha employee alleges company denied benefits claim despite evidence

MIAMI — An former Mutual of Omaha Insurance Co. employee is suing the company, citing alleged failure to uphold Americans with Disabilities Act regulations and violation of workers compensation acts.

Lady Deborah Nunnally filed a complaint in the U.S. District Court for the Southern District of Florida Miami Division against the insurance company alleging that it denied her disability benefits.

According to the complaint, the plaintiff alleges that she was found to be disabled according to the terms of the plan but was denied of any disability benefits. The plaintiff holds Mutual of Omaha Insurance Co. responsible because the defendant allegedly denied the plaintiff's application for long-term disability (LTD) benefits based on the views of its own medical consultants despite the plaintiff having sufficient medical evidence to support her claim.

The plaintiff seeks unpaid LTD benefits plus interest, all legal fees and any other relief as this court deems just. She is represented by Edward Philip Dabdoub and Geannina Burgos of Wagar Dabdoub P.A. in Miami.
