Former foreman alleges Leo's Concrete Specialties Inc. did not pay overtime wages

ORLANDO – A Brevard County man has filed a class-action lawsuit against a Palm Bay employer alleging he and class members were not properly paid.

Dustin Sauder filed a complaint on behalf of all others similarly situated on May 27 in the U.S. District Court for the Middle District of Florida against Leo's Concrete Specialties Inc. and Leo Badalamenti alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between November 2011 and March, he worked in excess of 40 hours per workweek but was not paid any overtime wages. The plaintiff holds Leo's Concrete Specialties Inc. and Badalamenti responsible because the defendants allegedly failed to pay plaintiff any overtime compensation.

The plaintiff requests a trial by jury and seeks compensation, compensatory damages, liquidated damages, interest, all legal fees and any other relief as the court deems just. He is represented by Joseph C. Wood and Maurice Arcadier of Arcadier & Associates PA in Melbourne.
