MIAMI – A Broward County man alleges a debt collector contacted him trying to collect a debt from another person.
Domenick A. Cuomo filed a complaint on May 23 in the U.S. District Court for the Southern District of Florida against AmeriFinancial Solutions LLC and John Doe alleging violation of the Telephone Consumers Protection Act.
According to the complaint, the plaintiff alleges that on July 21, 2014, he was called regarding a debt that was for another person. The plaintiff holds AmeriFinancial Solutions LLC and John Doe responsible because AmeriFinancial Solutions allegedly failed to identify the owner of the cellular telephone before contacting it and Doe allegedly provided AmeriFinancial with the plaintiff's number knowing it was a false representation.
The plaintiff requests a trial by jury and seeks all damages, all legal fees and any other relief as the court deems just. He is represented by Donald A. Yarbrough of Donald A. Yarbrough ESQ. in Fort Lauderdale.
