Suit filed against maker, seller of cradle cap product

FORT MYERS – A lawsuit claims that a product used to treat cradle cap on children caused burns.

Kara Wright, as personal representative of minor children Jane Doe 1 and Jane Doe 2, filed a complaint on May 27 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Insight Pharmaceuticals LLC and Wal-Mart Stores Inc. alleging negligence, strict liability and other counts.

According to the complaint, the plaintiff alleges that on May 25, 2012, Gentle Naturals Cradle Cap was used on the children to remove cradle cap during an outdoor bath. The suit states it was purchased at the Naples Walmart. As a result of using the product, the suit states the plaintiffs Jane Doe 1 and Jane Doe 2 suffered extensive burning on their heads, shoulders, faces and backs, permanent skin damage, medical expenses and the greater risk of skin cancer. The plaintiff holds Insight Pharmaceuticals LLC and Wal-Mart Stores Inc. responsible because the defendants allegedly defectively designed, manufactured and sold Gentle Naturals Cradle Cap and failed to provide adequate warnings.

The plaintiff requests a trial by jury and seeks judgment against defendants for all damages, prejudgment interest, costs of this action and for any other relief that the court considers proper. The plaintiffs are represented by Jeff Wright of Goede, Adamczyk, Deboest & Cross PLLC in Naples.
