MIAMI – A man alleges he was wrongfully terminated and not paid proper wages while working as a helper/mover.

Alexander Mayers filed a complaint on May 24 in the U.S. District Court for the Southern District of Florida against Forward Van Lines Inc., Payroll Management Inc. and Hagai Maman alleging that they violated the Fair Labor Standards Act and Florida private whistle-blower laws.

According to the complaint, the plaintiff alleges that, between June 2013 and April 12, he worked for 80 to 100 hours per week without proper compensation and was wrongfully classified as an independent contractor. The plaintiff holds Forward Van Lines Inc., Payroll Management Inc. and Hagai Maman responsible because the defendants allegedly paid him a fixed salary of $800 per week regardless of the amount of hours he worked, compensated him only for 40 hours of work per week and failed to pay him at time-and-one-half of his regular rate of pay for all hours worked in excess of 40 per week. He also alleges he was wrongfully terminated for providing statements to law enforcement regarding the death of a co-worker that he witnessed.

The plaintiff requests a trial by jury and seeks compensation for unpaid overtime wages, plus interest, liquidated damages, attorney’s fees and costs and for such other relief as the court deems just and proper.
