MIAMI – A passenger is suing a vessel alleging she was injured during a trip.
Maria Rioseco filed a complaint on May 20 in the U.S. District Court for the Southern District of Florida, Miami Division against Bimini Superfast Operation LLC and Bimini Superfast Charter Limited alleging negligence.
According to the complaint, the plaintiff alleges that on June 14, 2015, she was severely injured when she fell on the Bimini SuperFast's gangway due to an uneven surface. As a direct and proximate result of defendant's negligence, she alleges she has suffered physical pain, mental anguish, loss of enjoyment of life, disability, disfigurement and lost income.
The plaintiff holds Bimini Superfast Operation LLC and Bimini Superfast Charter Limited responsible because the defendants allegedly failed to provide a reasonable care, failed to provide an adequate gangway, failed to provide adequate handrails and/or grips, failed to assist passengers to safely embark the vessel from the port and failed to provide adequate assistance.
The plaintiff requests a trial by jury and seeks judgment for all damages recoverable under the law against defendants. She is represented by Jason R. Margulies and Jacqueline Garcell of Lipcon, Margulies, Alsina & Winkleman PA in Miami.
