Woman claims LINA wrongfully denied benefits

MIAMI – A disabled woman is suing Life Insurance Co. of North America claiming it wrongfully denied her benefits.

Susan Tatem filed a complaint on May 20 in the U.S. District Court for the Southern District of Florida against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she has not received her benefits under the long-term disability plan, causing her to suffer unnecessary trouble, expenses and emotional distress. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly failed to discharge its fiduciary responsibilities, failed to recognize her claim for disability and refused and denied to pay her benefits to which she is entitled.

The plaintiff requests a trial by jury and seeks judgment against the defendant for unpaid benefits, attorney's fees and costs and for such other and further relief as this the court deems just and proper. She is represented by John P. Murray of The Murray Law Firm PA in Coral Gables.
