Exploria LLC accused of calling numbers on Do Not Call Registry

OCALA – A Texas man has filed a class-action complaint against a Clermont company over claims of harassing sales tactics.

Timothy Craig filed a complaint on behalf of all others similarly situated on May 17 in the U.S. District Court for the Middle District of Florida, Ocala Division against Club Exploria LLC alleging that the telemarketing company violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that from Nov. 15, 2015, and continuing to the present, he has received five unwanted telemarketing calls per week from the defendant, causing him to suffer actual harm, including aggravation, annoyance and invasion of privacy and statutory rights. The suit states his number is on the National Do Not Call Registry.

The plaintiff holds Club Exploria LLC responsible because the defendant allegedly placed unsolicited phone calls using an automatic telephone dialing system in an effort to sell its timeshare properties and vacation packages. It allegedly continued to call him even after his request to stop calling him.

The plaintiff seeks compensation for all damages, reasonable attorneys' fees and costs and such other relief that the court deems reasonable and just. He is represented by David P.
