Former CYN Nightclub employee alleges he was wrongfully terminated

FORT LAUDERDALE – A man alleges he was wrongfully terminated by a nightclub after complaining that he wasn't being paid properly.

Lance Peter Tomassi filed a complaint on May 16 in the U.S. District Court for the Southern District of Florida, Broward Division against Bam Bam Entertainment LLC, doing business as CYN Nightclub, Louis Atallah and Ehab Atallah alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that throughout his employment from Sept. 1, 2015, until his termination on April 15, he worked for more than 40 hours per week without proper compensation and was paid at a rate below the minimum applicable hourly wage rate. The plaintiff holds Bam Bam Entertainment LLC, Louis Atallah and Ehab Atallah responsible because the defendants allegedly failed to pay his extra hours at a rate of one-and-one-half of his regular rate for all hours worked in excess of 40 in a single week and terminated his employment in retaliation for complaining about not being properly paid.

The plaintiff requests a trial by jury and seeks declaration that defendants have violated FLSA, compensation for unpaid wages, liquidated damages, attorneys' fees and costs and such additional relief as the court deems just and proper under the circumstances. He is represented by Peter M. Hoogerwoerd of Remer & Georges-Pierre PLLC in Miami.
