MIAMI – A former Health First employee alleges her disability benefits were wrongfully terminated.
Patricia Paris filed a complaint on May 11 in the U.S. District Court for the Southern District of Florida against Life Insurance Co. of North America alleging that the payer of plan benefits violated the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that her claim for benefits was terminated on June 18, 2015, after having received it shortly after becoming disabled on Dec. 5, 2014. As a result she alleges she has suffered damages for loss of disability benefits. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly terminated and refused to continue paying her benefits under the employee welfare benefit plan, failed to provide reasonable explanation of the basis for the termination of her disability claim and failed to adequately investigate the merits of her claim.
The plaintiff requests a trial by jury and seeks an order for her immediate reinstatement to the policy, compensation for disability benefits due, all costs and attorneys’ fees, prejudgment and post-judgment interest and such other and further relief as the court deems just and proper.
