Man alleges he was injured by medical transport service

MIAMI – A couple alleges that the husband was injured due to a driver's negligence while being transported from dialysis treatments.

Rodolfo Prieto and Blanca Prieto filed a complaint on May 10 in the U.S. District Court for the Southern District of Florida, Miami Division against Falck USA Inc., doing business as American Ambulance Service Inc., Medical Transportation Management Corp. and AMC Medical Transportation alleging negligence.

According to the complaint, the plaintiffs allege that on Jan. 2, while Rodolfo Prieto, 76, was being transported by the defendant when suddenly and without warning the driver sharply applied the brakes, causing him to fly forward towards the front of the van. He alleges he sustained various injuries, including but not limited to a fractured right leg. The plaintiffs holds Falck USA Inc. responsible because the defendants' driver allegedly failed to properly and carefully operate the vehicle, failed to keep proper lookout and failed to adequately apply breaks to stop the vehicle.

The plaintiffs request a trial by jury and seek judgment against the defendant for damages and an expedited trial because plaintiffs are older than the age of 65. They are represented by Kelsay D. Patterson of Law Offices of Kelsay D. Patterson in Tampa.
