Class action filed against Suncoast Credit Union over debt collection practices

Late 05

TAMPA – A Hernando County consumer has filed a class-action suit against a creditor alleging it continued to try to collect a discharged debt.

Joyce A. Kruzell filed a complaint on May 6 in the Tampa Division of the Middle District of Florida against Suncoast Credit Union alleging violation of the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that she has suffered and will continue to suffer damages until the defendant is restrained by the court. The plaintiff holds Suncoast Credit Union responsible because the defendant allegedly attempted to collect a debt directly from her even though the defendant was instructed that she is represented by a lawyer, that she had filed bankruptcy and the debt had been discharged.

The plaintiff requests a trial by jury and seeks compensation for damages, attorneys' fees and costs and all such other relief as is deemed necessary and appropriate. She is represented by Katherine Earle Yanes of Kynes, Markman & Felman PA in Tampa and Brian L. Shrader and Gus M. Centrone of Centrone & Shrader PLLC in Tampa.
