Salesman alleges he was not paid overtime while working at Colonial Imports

ORLANDO – A car salesman alleges he was willfully not paid overtime by his former employers.

Frank J. Sifonte filed a complaint on May 6 in the U.S. District Court for the Middle District of Florida, Orlando Division against Colonial Imports LTD, doing business as Don Mealey Sport Subaru Mitsubishi, and Whit Gilman alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he regularly worked for an average of 70 to 80 hours per week without receiving any compensation of overtime wages for all hours over 40 per week during his employment with the defendants from June 2014 to March. The plaintiff holds Colonial Imports LTD and Whit Gilman responsible because the defendants allegedly failed to compensate him at a rate of one-and-one-half of his regular rate for each hour worked over 40 hours in a workweek and terminated him because he complained that he was not being paid for the hours that he worked.

The plaintiff requests a trial by jury and seeks compensation for all damages, attorneys' fees and costs and such other relief as the court deems equitable and just. He is represented by Chad A. Barr of Law Office of Chad A. Barr PA in Maitland.
