Norwegian Gem passenger alleges she fell on poorly lit stairs

MIAMI – A Norwegian Gem passenger is suing the vessel's operator over allegations she was injured while on the ship.

Dianna Smith filed a complaint on May 5 in the U.S. District Court for the Southern District of Florida, Miami Division against NCL (Bahamas) LTD, doing business as Norwegian Cruise Line, alleging negligence.

According to the complaint, the plaintiff alleges that on April 5, 2014, while she was attempting to navigate the passenger stairway between Deck 13 and Deck 12, she lost her footing, fell to the bottom of the stairs and incurred serious injuries, resulting in pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, medical expenses and loss of earnings. The plaintiff holds Norwegian Cruise Line responsible because the defendant allegedly failed to warn her of the presence of a dangerous condition, failed to install adequate lighting in the area and failed to design and construct the stairs in uniform width and/or height.

The plaintiff requests a trial by jury and seeks judgment for damages against the defendant, for costs of this action, prejudgment interest and any other relief deemed just and appropriate by the court. She is represented by Jennifer C. Thompson of Waks & Barnett PA in Miami.
