MIAMI – A cook claims a Boca Raton restaurant owes him unpaid wages.
Brian Young filed a complaint on May 5 in the U.S. District Court for the Southern District of Florida against J&J Boca II LLC, doing business as Fresh Kitchen, and Brandi Levinson alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he regularly worked for 60 to 65 hours per workweek, for five to six days per week without proper overtime compensation during his employment with the defendant from August 2015 to April 7. He alleges he has suffered damages plus incurring costs and reasonable attorneys' fees.
The plaintiff holds J&J Boca II LLC and Levinson responsible because the defendants allegedly misclassified him as an exempt employee, failed to pay his overtime wages at the rate of one-and-one-half of his regular rate for each hour worked in excess of 40 hours per week, refused to pay for his son’s medical coverage and deducted $260.64 from two paychecks on March 21 and April 4.
The plaintiff requests a trial by jury and seeks compensation for overtime wages, salary and lost benefits, plus interest, liquidated damages, attorney's fees and costs and such other relief as the court deems just and proper.
