MIAMI – An assistant manager is suing his former employee alleging that he was not paid overtime wages while working in the security department.

Rudy Rife filed a complaint on May 3 in the U.S. District Court for the Southern District of Florida against Fronton Holdings LLC, doing business as Casino Miami, and Dave Jonas alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he routinely worked more than 40 hours in a work week but did not receive overtime payment during his employment from November 2012 to April. The plaintiff holds Fronton Holdings LLC and Jonas responsible because the defendants allegedly failed and refused to pay his overtime wages calculated at time-and-one-half of his regular rate of pay for all hours worked over 40 hours in a given work week and recklessly failed to investigate whether their failure to pay overtime wages violated the law.

The plaintiff requests a trial by jury and seeks reasonable attorney's fees, costs and expenses and such other and further relief as the court deems just and proper. He is represented by Brian H. Pollock of Fairlaw Firm in Miami.
