Sarasota man files suit alleging battery, assault by US Marshals

TAMPA – A man is suing United States of America over allegations that U.S. Marshals assaulted him in a raid.

Rashard Jabari Hodo filed a complaint on May 2 in the Tampa Division of the Middle District of Florida against United States of America alleging assault and battery.

According to the complaint, the plaintiff alleges that on June 21, 2013, U.S. Marshal Matt Wiggins and other unnamed U.S. Marshals pulled him out of his house in a raid and failed to find the criminal suspect they were looking for. He alleges they threw him to the ground, berated and called him a liar, causing him great embarrassment, anxiety and emotional distress. The plaintiff holds United States of America responsible because the defendant allegedly failed to respond and/or adjudicate his claims for damages that he submitted on May 18, 2015.

The plaintiff requests a trial by jury and seeks judgement against defendant, for all damages allowable by law, costs of this action and such other relief as the court meet and proper. He is represented by Vincent M. D'Assaro of Morgan & Morgan PA in Orlando.
