WEST PALM BEACH – A Palm Beach factoring business has filed suit against a California business alleging it is owed a debt.
Gateway Commercial Finance LLC filed a complaint on May 3 in the U.S. District Court for the Southern District of Florida, West Palm Beach Division against NRG Building and Consulting Inc. citing breach of factoring agreement.
According to the complaint, the plaintiff alleges that pursuant to their factoring agreement, plaintiff issued notice of assignments to the defendant's costumers that the defendant sold and assigned all accounts to them and that payments of the accounts shall be remitted directly to them. No payment has been made, causing plaintiff to suffer damages in the amount of $81,469.80, the suit states. The plaintiff holds NRG Building and Consulting Inc. responsible because the defendant allegedly improperly instructed its account debtors to pay all accounts to it and failed to relinquish possession of the accounts or proceeds.
The plaintiff requests a trial by jury and seeks compensation for all monies wrongfully converted by defendant, prejudgment and post-judgment interest, attorneys' fees and costs and such other relief as the court deems appropriate.
