Man alleges CSX Transportation Inc. terminated him for taking leave

ORLANDO – A Jacksonville man alleges he was terminated because of taking medical leave.

Gary S. Harrell filed a complaint on May 4 in the U.S. District Court for the Middle District of Florida against CSX Transportation Inc. alleging violation of the Family Medical Leave Act.

According to the complaint, the plaintiff alleges that took leave under FMLA in 2015 for a medical condition. The plaintiff holds CSX Transportation Inc. responsible because the defendant allegedly failed to provide written notice of an incomplete certification and terminated his employment on July 7, 2015, due to accrual of absences due to a health condition that constitute a denial of FMLA benefits.

The plaintiff requests a trial by jury and seeks an order for defendant to reinstate him, compensation for all damages, prejudgment interest, attorney's fees and costs and such other relief that he is entitled under the law.
