Woman accuses Lincoln National Life Insurance of wrongfully denying benefits

Insurance 09

JACKSONVILLE – A Duval County resident alleges she is disabled but was wrongfully denied benefits by her insurance company.

Maria R. De Los Santos filed a complaint on May 2 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against The Lincoln National Life Insurance Co. alleging that the claims administrator allegedly violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she has been damaged for not receiving her benefits under the long-term disability plan to which she claims she is entitled.

The plaintiff requests a trial by jury and seeks judgment against the defendant for payment of disability benefits due and owing under the plan, plus interest, costs and attorney's fees. She is represented by Thomas M. Farrell of Farrell Disability Law in Jacksonville.
