Wainwright & Associates Material Supply accused of not paying for supplies

JACKSONVILLE – A Georgia lumber supplier is suing a Live Oak company alleging it is owed for materials delivered.

Harbin Lumber Co. Inc. filed a complaint on May 2 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against the defendants alleging that they failed to comply with the terms of the credit agreement and guarantee.

According to the complaint, the plaintiff alleges that from Nov. 2, 2015, through Jan. 21, it supplied and delivered defendant's ordered materials in the principal amount of $100,026.02. The plaintiff holds Wainwright & Associates Material Supply LLC and Joseph B. Wainwright Sr. responsible because the defendants allegedly failed and refused to pay the materials when due.

The plaintiff requests a trial by jury and seeks judgment for damages against defendant, together with prejudgment interest, attorneys' fees and costs and for any other further relief as the court deems just and proper. It is represented by Brandon C. Meadows and Charles B. Jimerson of Jimerson & Cobb PA in Jacksonville.
