MIAMI – A man has filed suit against his former employer alleging that he regularly worked more than 40 hours per week but was not paid overtime wages.
Eduardo Percival filed a complaint on May 4 in the U.S. District Court for the Southern District of Florida against Deerfield 21 Corp. and Cheryl Chase alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that during his employment with the defendants, he worked for more than 40 hours per work week without proper compensation. The plaintiff holds Deerfield 21 Corp. and Cheryl Chase responsible because the defendants allegedly willfully refused to properly compensate him for all hours worked in excess of 40 hours per week.
The plaintiff requests a trial by jury and seeks compensation for all damages, including liquidated damages, prejudgment interest, attorney's fees, costs and expenses, and all other relief that the court may deem just and proper.
