Synchroncy Bank accused of telephone harassment

JACKSONVILLE – A St. Johns County man alleges a bank has continued to call him in an attempt to reach another person.

James P. Bowen IV filed a complaint on April 29 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against Synchrony Bank alleging that the debt collector violated the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that he has received approximately 147 calls between Nov. 25, 2015, and Jan. 21 in an attempt to collect a debt that belongs to another person. The plaintiff holds Synchrony Bank responsible because the defendant allegedly intentionally harassed and abused him by calling several times in one day and on back-to-back days, made calls using an automatic telephone dialing system and/or pre-recorded or artificial voice. The calls allegedly continued even after he requested them to stop calling him.

The plaintiff requests a trial by jury and seeks judgment against defendant enjoining them from further violations of the TCPA, compensation for all damages, attorney's fees, costs and any other relief that the court may deem just and proper.
