TAMPA – An air conditioning service technician alleges his former employer did not pay him for two weeks of work.
Eric Brewner filed a complaint on April 25 in the Tampa Division of the Middle District of Florida against Healthy Home of Allergy & Indoor Air Pollution Products Inc., Mike Hudson and Patricia Saavedra alleging that they allegedly violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that on Aug. 21, 2015, his second paycheck from working with the defendants was dishonored. He worked approximately 50 hours per week during the relevant time period without proper compensation, the suit states. The plaintiff holds Healthy Home of Allergy & Indoor Air Pollution Products Inc., Mike Hudson and Patricia Saavedra responsible because the defendants allegedly failed and refused to replace the dishonored paycheck or otherwise compensate him for any work performed during the relevant time period, failed to issue any payment on his third week of work, failed to pay any of his commissions and failed to compensate him at the statutory rate of one-and-one-half times his regular rate of pay.
The plaintiff requests a trial by jury and seeks compensation for unpaid minimum wages, liquidated damages, attorneys’ fees, costs, prejudgment interest and such other and further relief as the court may deem proper. He is represented by Joseph P. Kenny and Paul M. Crochet of Weber, Crabb, & Wein PA in St. Petersburg.
