Man claims Xarelto caused damages

MIAMI – A man has filed a suit against multiple pharmaceutical companies alleging a prescription drug caused life-threatening bleeding.

Robert Gamble filed a complaint on April 21 in the U.S. District Court for the Southern District of Florida against Janssen Research & Development LLC, Janssen Ortho LLC, Janssen Pharmaceuticals Inc., Bayer Healthcare Pharmaceuticals Inc., Bayer Pharma AG, Bayer Corp., Bayer Healthcare LLC, Bayer Healthcare AG and Bayer AG citing alleged breach of express and implied warranty, fraudulent misrepresentation, fraudulent concealment and other counts.

According to the complaint, the plaintiff alleges that between August 2015 and October 2015, he used Xarelto upon direction of his physician for the treatment of blood clots and atrial fibrillation. As a direct and proximate result of using Xarelto, he alleges he was caused to suffer life-threatening bleeding and was hospitalized on Oct. 5, 2015. He also claims he was caused to sustain severe and permanent personal injuries, pain, suffering, mental anguish and emotional distress, shortened life expectancy, expenses for hospitalization and medical treatment, loss of earnings, loss of the ability to earn money and other damages.

The plaintiff holds the defendants responsible because the defendants allegedly designed, researched, manufactured, tested, advertised, promoted, marketed, distributed and sold Xarelto; failed to properly investigate, research, study and define the safety profile of the drug; failed to adequately test it; failed to provide adequate warnings; failed to disclose the need for dose adjustments; and failed to provide adequate instructions.

The plaintiff requests a trial by jury and seeks compensation for damages in excess of the jurisdictional amount, economic damages, exemplary damages, prejudgment and post-judgment interest, reasonable attorneys’ fees and costs and such other and further relief as the court may deem just and proper.
