Woman alleges Bisk Education retaliated against her for taking leave

TAMPA – A Hillsborough County woman alleges she was wrongfully terminated after making a request for maternity leave.

Monique Swift filed a complaint on April 20 in the Tampa Division of the Middle District of Florida against Bisk Education Inc. alleging that the former employer violated the Family Medical Leave Act.

According to the complaint, the plaintiff alleges that on Jan. 29, her maternity-related leave was approved and on that same date, she was suspended from work. She alleges was terminated on Feb. 2. As a result, she claims she has suffered damages for loss of income and benefits. The plaintiff holds Bisk Education Inc. responsible because the defendant allegedly interfered with her rights and retaliated against her for exercising those rights.

The plaintiff requests a trial by jury and seeks judgment that the defendant's actions are in violation of FMLA, reinstatement to a position comparable to her prior position compensation for lost wages and benefits, liquidated damages, prejudgment interest, attorney's fees and for such other relief as the court may deem just and proper.
