Former employee alleges Metals Trading Corp. did not adequately pay him

MIAMI – A Dade County man has filed suit against his former employer and its owners alleging he was paid less than minimum wage during his employment.

Eugenio Reyes Gamez filed a complaint on April 20 in the U.S. District Court for the Southern District of Florida against Metals Trading Corp., Adiany Perez and Alex Fagundo alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Nov. 10, 2015, and March 15, he worked an average of 80 hours a week, was paid an average of $3.75 per hour and was not paid any overtime and/or minimum wages for work performed in excess of 40 hours weekly. The plaintiff holds International Metals Trading Corp., Perez and Fagundo responsible because the defendants allegedly willfully and intentionally refused to pay him the applicable minimum wage for all hours worked, failed to pay overtime premium for those hours worked over 40 per week, and failed to investigate whether their payroll practices were in accordance with the law.

The plaintiff requests a trial by jury and seeks compensation for double damages, reasonable attorney fees and any other relief that the court may find reasonable under the circumstances. He is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
